Rep. Craig Williams from Pennsylvania has introduced a legislative proposal aiming to hold public officials accountable for failing to adhere to federal immigration laws. If enacted, the bill would enable private citizens to sue officials who intentionally ignore federal immigration detainers, specifically those from U.S. Immigration and Customs Enforcement (ICE). The legislation seeks to create a legal exception to the protections of sovereign and governmental immunity, thus allowing individuals to seek damages caused by the release of undocumented immigrants.
Officials across various municipalities in the Commonwealth have reportedly adopted local measures that instruct law enforcement to disregard ICE detainers or refrain from reporting the status of undocumented individuals in custody. Rep. Williams stated, “The public deserves to know their government is prioritizing their safety. When officials refuse to cooperate with federal immigration authorities – or worse – intentionally thwart the efforts of federal authorities to remove violent criminals from our country, they create avoidable dangers in our communities.”
Williams highlighted the case of Laken Riley, a young nursing student murdered in February 2024, as a poignant example of the potential dangers of releasing undocumented offenders. Her alleged killer, José Antonio Ibarra, had a history of arrests and was released despite being detained as an illegal immigrant. “Had Ibarra been held, Laken would be alive today,” Williams claimed.
Recently, the federal Laken Riley Act was enacted, mandating the detention of undocumented immigrants accused of severe crimes. According to the Department of Homeland Security, the act requires federal authorities to detain immigrants implicated in offenses such as theft, assault on law enforcement, and serious bodily harm crimes. Williams’ proposed legislation is meant to complement this federal act by addressing state-level responsibilities and imposing consequences for noncompliance.
The bill permits lawsuits against public officials who create or support sanctuary policies, holding them liable for harm resulting from releasing undocumented immigrants. Williams commented, “We should not be in the business of providing legal sanctuary by way of immunity to officials who put the public in harm’s way – intentionally.”
